Understanding Intestacy: If You Die Without an Estate Plan
When a person dies without having a valid will in place, his or her property passes by what is called "intestate succession" to heirs according to state law. In other words, if you don't have a will, the state will make one for you. All fifty states have laws (or -statutes-) of this kind on the books.
The purpose of intestate succession statutes is to distribute the decedent's wealth in a manner that closely represents how the average person would have designed his or her estate plan, had that person had a will. However, this default can differ dramatically from what the person really would have wanted. Even where it is known what the person intended, no exceptions are made where no valid will exists. Nor are there any exceptions made based on need or special circumstances.
1990 UNIFORM PROBATE CODE
The 1990 Uniform Probate Code (the Code) serves as the starting point for many states' laws. Nevertheless, the laws of different states can vary greatly from each other and from the Code itself. However, the Code represents the best reference for a general discussion.
Under the Code, close relatives take property instead of distant relatives. The classes of relatives whose members receive property under the Code include the decedent's surviving spouse, descendents (children, grandchildren, etc.), parents, descendents of decedent's parents (siblings, nieces and nephews), grandparents, and descendents of grandparents (aunts and uncles and cousins). Adopted descendents are treated the same as biological descendents. If none of the above-named classes of relatives include any persons qualified to take the estate, the property "escheats" (goes by default) to the state.

Share Of Surviving Spouse
Under the Code, a surviving spouse is either entitled to the entire estate (after expenses and taxes of the decedent) or a substantial part of it. For example:
o
The surviving spouse is entitled to the entire net estate if the decedent is also survived by children who are all children of the decedent and the surviving spouse.
o
The surviving spouse is also entitled to the entire net estate if the decedent is not survived by descendents and parents.
o
If parents survive but no descendents survive, a surviving spouse takes the first $200,000 of the net estate plus three-fourths of anything exceeding that amount.
o
If the decedent is survived by descendents who are also the descendents of the surviving spouse, and by descendents who are not descendents of the surviving spouse, the surviving spouse takes the first $150,000 of the net estate plus one-half of anything exceeding that amount.
o
If the decedent is not survived by any descendents who are also descendent of the surviving spouse but is survived by descendents who are not descendents of the surviving spouse, the surviving spouse takes the first $100,000 of the net estate plus one-half of anything exceeding that amount.

Under the Code, if no spouse survives but descendents of the decedent survive, the descendents take the entire net estate by "right of representation."

Under the Code, if a decedent is not survived by a spouse or descendents, the entire net estate passes to the decedent's parents equally or, if only one survives, to the survivor.

Under the Code, if a decedent is not survived by a spouse, descendents, or parents, the entire net estate passes to the decedent's parent's descendents (siblings of the decedent). If there are no siblings or descendents of siblings, the net estate goes to the decedent's grandparents or their descendents.

Net Estate
The "Net Estate" is the amount left for distribution to heirs after all debts, family protections, taxes, and administrative expenses have been paid. "Family protections" include homestead allowances, family allowances, and exempt property allowances. -
What is Estate Planning?
Estate planning is one of the most important steps any person can take to make sure that their final property and health care wishes are honored, and that loved ones are provided for in their absence. Though often overlooked or put off in favor of more immediate concerns, a comprehensive estate plan can resolve a number of legal questions that arise whenever anyone dies: What is the state of their financial affairs? What real and personal property do they own? Who gets what? Does a personal guardian need to be appointed to care for minor children? How much tax will need to be paid in order to transfer property ownership? What funeral arrangements are appropriate?
What is an "Estate"?
Your "estate" consists of all property owned by you at the time of your death, including:
* Real estate
* Bank accounts
* Stocks and other securities,
* Life insurance policies,
* Personal property such as automobiles, jewelry, and artwork.
How Can an Estate Plan Help?
Regardless of your age, or the size and complexity of your estate, an estate plan can accomplish the following:
* Identify the family members and other loved ones that you wish to receive your property after your death.
* Ensure that your property will be transferred to those you have identified, as quickly and with as few legal hurdles as possible.
* Minimize the amount of taxes that will need to be paid in order for your property to pass to others after your death.
* Avoid the time and costs associated with the probate process by utilizing estate planning devices like living trusts and "payable on death" bank accounts.
* Dictate the kinds of life-prolonging medical care you wish to receive should you be unable to make your wishes known when the time comes.
* Set forth the kind of funeral arrangements you would like, and how related expenses are to be paid.

Scalp or Swing ?
Scalping is a term that goes back to pit trading at the exchanges, where the floor traders, being members, didn't have to worry about spread. After making one point, they would close the position. This was done up to 60 times a session and even the younger members found it exhausting!
With FX, I don't think precisely the same method is practicable. There is too much volatility. And why risk 25 pips to make 10, say, when the amplitude of a micro-cycle, on the yen crosses for example, is 120-160?
I prefer the method of swing trading, which is basically buy low and sell high. You can try the following:
1. Open a 5-min chart on EURJPY and put on stochastic (9-5-3) and RSI (9). I prefer to have RSI as a histogram as it is clearer to me. You can also use plain momentum as an oscillator.
2. Preparation: identify the bias over the past five hour cycle. Let us assume the direction is now up, so we will be buying not selling.
3. Signal: stochs must visit 20 or lower to start you off. This is often accompanied by RSI doing a low around 22. This is your alert. You are not trying to buy the indicator low!
4. Trigger: you must have one, or you will never enter the market! A trigger is a hard rule you always follow. I suggest a good trigger is a line on stochs at 46. If the %K moves over that line, they are buying, so you can join them. If it baulks at that level and returns lower, the cart is still pulling the horse. 46 can also act as a support level for a second surge, which is very lucrative.
Generally, because financial markets move in a compound series of half sine waves (like frogs hopping along a pathway), if the indicators visit a low, eventually they WILL get back to a high (stochs around 90 on this setup, RSI at least 65). However, you cannot just buy and sell the indicator levels - the world is not so simple.
Tips:
The higher cycle bias will predominate, so you need to check the 2-hour and 30-min charts for the status.
Don't sell in an upswing or buy in a downswing of the cycle.
Start with buying - it is a lot easier to identify a low node than a top node. Selling is a different game.
Closing a position is up to you. But I often wait for a second surge and possible negative divergence on indies. Alternatively, you may be content with 120 pips and use a limit order. -
The Opportunities of Trading the Forex Hedged Grid System
I have seen the hedged grid system been used successfully (and highly unsuccessfully) over the last few years. Unfortunately the failures tend to discourage traders from taking advantage of this great system. I have found that the failures are mainly due to ignorance, impatience and greed (common reasons for trading failure).
In a nutshell the grid system uses the following methodology. You start by buying and selling a currency. When the price moves a predetermined distance (grid leg) you cash in the positive leg, leave the negative leg and buy and sell again. Sooner or later the system goes positive and you would then cash in when it is positive.
This is a brief summary of the content of our free hedged grid trading course available on expert-4x.com. Please refer to this course for more details of how money is made. The attraction is that the system is reasonably mechanical, can be programmed and does not take much supervision as exclusively entry orders are used.
Money is made when the price retraces 100%, 50%, 33% at various levels. This starts looking like a strategy that supports the Fibonacci concept. The grid system is also based on the nature of the market to trade sideways 80% of the time and to trend 20% of the time.
The dangers are that what if the price does not retrace and continues to trend. The Grid system can not make money in a trending market — full stop. One has to realize that. You therefore need Strategies to minimize damage during these periods:-
Firstly I have found that the biggest mistake made by traders is that they select a very small grid leg sizes e.g. 20 to 30 pips. This is a recipe for disaster. The trick is to use big leg sizes between 150 and 300 pips. What this does is that it sometimes turns a trending phase into movement in a sideways market. I would typically use 300 pips for the GBPJPY and 150 pips for the EURUSD for instance.
Secondly there is no rule that says that the legs have to be the same size. So I change my leg sizes in trending markets to be even bigger. If I started with 150 for the 1st leg I would go to 200 for the 2nd leg and 250 for the 3rd leg etc. This makes sure that I am carrying less loss making transactions in a trend.
Thirdly — sometimes it is wise to increase the number of lots with the trend compared to the numbers against the trend in a good trend. However be aware of having the same number of sell and buy transactions. All you will have done was lock in your current status in a 100% hedge.
Fourthly — This is the biggest change and most important one that I personally have made in my grid trading strategy. Always cash in all your transactions when your system is positive and when the price reaches the end of one of your grid legs. By cashing in you are reducing the risk of carrying negative lots in a trending market. This also gives you an opportunity to re-assess the market conditions.
Fifthly:- Cash in a start again is always an option. One of my strategies is to cash in all my open positions when the 3rd leg of my grid is reached and start again. Experience has taught me that this is a short term pain that goes away very quickly and is soon forgotten.

1. Don’t use them on meaningless data
More traders than ever are day trading and their losing.
The reason why is simple the time frame is to short and all volatility in daily periods is random and therefore NO technical indicator will give you any advantage, pivot points, moving averages, or any other indicator can help you make profits.
Ever seen a day trading vendor who has real time track record of profits?
You won’t!
Because it doesn’t work, volatility can and does, go anywhere in a day and traders lose – it’s as simple as that.
2. You can’t time entries with them!
Moving averages define the longer term trend; pivot points indicate points of rotation by definition, so they are telling you where prices may find support or resistance - nothing more.
Many traders like to simply wait for prices to reach the levels and enter their trades and then hope prices turn in the direction they anticipating, but if you rely on “hope” you will lose.
Never trade on “hope” trade with the odds in your favour.
This means when prices move towards the price levels you are looking at, you need to get the odds in your favour and that means combining them with momentum indicators to time your trading signals with the risk to reward I your favour.
You need evidence that price momentum is indicating the levels will hold.
If for example, prices move to support and price momentum turns up, you have the odds in your favour that support will hold and you can execute your trading signals.
Good momentum indicators are ones such as, the stochastic and Relative Strength Index (RSI) and if used with pivot points or moving averages, you have a powerful combination.
It’s all about combining indicators for profit – no indicator works on its own, so you need indicators that complement each other.
THE Biggest Mistake any Trader Can Make.
Is to try and “predict” market direction. Most day traders do this as standard and most people who use pivot points and moving averages, who try and execute trading signals with them are doing the same.
You can’t predict turning points so don’t try – act on confirmation and you will increase your odds of success dramatically.
Keep in mind trading is an odds game not a game of guessing, hoping or predicting – if you remember that and use it to your advantage you can avoid a fatal mistake most forex traders make.
